  1. There is a legal limit if you want to stay classified as a food, or well beverage. It’s based on concentration. For a 12oz beverage the limit is 71mg. Pepsi Max is 69mg, close to the limit. You don’t want to push it any closer than that for safety.
    Of you don’t care about being a beverage, you can make a dietary supplement. This way energy drinks are, supplements. You can go much higher. There doesn’t need to be a limit here because no one is going to go that high.
    No one wants more than 300mg per serving. If someone feels like more than 300mg in a day, they want it over multiple servings. There’s no business reason to sell a 600mg energy drink, when your customers would be just fine with 3 x 200mg ones. This is a high dose that very few people would want often. Like I said, if they do, they prefer it over multiple servings, different products, flavors, etc.
    You don’t make more money by putting in more caffeine. People may pay a small premium for higher caffeine, but not proportional. I won’t pay you the price of two drinks for a double strong drink. I want the extra drink part with my caffeine. You’d make more by people using multiple servings. You need enough caffeine for your product to be seen as preferable.
    40mg per peice of gum seems reasonable. I wouldn’t want gum with just 10mg. That’s too little, requires too much gum and money. I wouldn’t want gum with 80mg. What if I want less at the time? I’d rather have the 40 for when I want 40 and just have two gums if I want 80. Gum may be used in the afternoon or evening to provide a bit of Extra boost, but you don’t want so much that it messes up your sleep. You may want enough to help you stay up two extra hours, not enough to stay up all night.
